<p><span style="font-size:12pt;font-family:Arial;">Mengikut ketetapan Kod 4 (7) Kod Tata Kelakuan Profesional Arkitek di bawah Kod 4 &#8211; <b><u>Integriti Profesional,</u></b> seseorang Arkitek dibenarkan mengiklankan perkhidmatan profesionalnya dalam apa sahaja bentuk dengan syarat pengiklanan yang dibuat tersebut menepati garispanduan-garispanduan yang dikeluarkan oleh Lembaga Arkitek Malaysia. </span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><b><span style="font-size:12pt;font-family:Arial;">4(7)<span>     </span>Seseorang Arkitek boleh mengiklankan perkhidmatan profesionalnya melalui mana-mana cara iklan awam, dengan syarat pengiklanan yang dibuat tersebut menepati atau mengikut garispanduan atau pekeliling yang dikeluarkan oleh Lembaga.</span></b><b><i><span style="font-size:12pt;"><font face="Times New Roman"> </font></span></i></b></p>

<p><span style="font-size:12pt;font-family:Arial;">Sepertimana yang dijelaskan oleh <a href="http://www.lam.gov.my/download/gcn031997eng.pdf" title="Pekeliling LAM">Pekeliling Am LAM 3/1997</a>, tujuan Arkitek mengiklankan perkhidmatan profesionalnya secara lazim adalah:</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><span style="font-size:12pt;font-family:Arial;">Untuk memaklumkan kepada pihak awam mengenai perkhidmatan profesionalnya [tidak kira samada kos terlibat ditanggung oleh Arkitek sendiri atau sebaliknya].</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><span style="font-size:12pt;font-family:Arial;">Dalam masa yang sama mengumumkan semua maklumat lain yang relevan dengan perkhidmatan profesionalnya.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>

<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><span style="font-size:12pt;font-family:Arial;">Pengumuman dibuat tentang penglibatan Arkitek dalam risalah-risalah jualan dan dalam apa-apa sahaja dokumen yang dikeluarkan untuk pembeli – yang penting maklumat yang diberikan MESTILAH TEPAT.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>

Tanda tersebut hendaklah dilokasi yang sesuai dan dalam suatu bentuk yang akan dapat dipamerkan secara kekal dan mengandungi maklumat penting seperti tahun bangunan itu siap serta No. Pendaftaran Arkitek berkenaan.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><u><span style="font-size:12pt;font-family:Arial;">Papan tanda bagi pejabat dan projek</span></u><span style="font-size:12pt;font-family:Arial;"> -<span>  </span>Para Arkitek dibenarkan meletak pada bangunan pejabat mereka nama praktis dalam bentuk dan saiz yang berpatutan dan meliputi logo mereka bagi menunjukkan identiti yang dihajati. Papan tanda projek yang memberi maklumat yang diperlukan di bawah mana-mana perundangan boleh didirikan di Tapak Bina dalam suatu saiz dan gaya yang sesuai dan meliputi logo praktis Arkitek itu supaya dapat dilihat oleh orang awam.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><u><span style="font-size:12pt;font-family:Arial;">Pengumuman dan felicitation</span></u><span style="font-size:12pt;font-family:Arial;"> – iklan-iklan yang berupa pengumuman atau ‘fecilitation’ dalam akhbar boleh mengandungi nama dan profesion Arkitek serta meliputi logo praktis di mana sesuai.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><u><span style="font-size:12pt;font-family:Arial;">Iklan serta risalah jualan dan promosi</span></u><span style="font-size:12pt;font-family:Arial;"> – percetakan nama-nama dan butir-butir mengenai para Arkitek [termasuk nombor pendaftaran mereka] dalam iklan dan risalah jualan dan promosi bagi bangunan yang hendak dijual kepada awam digalakkan oleh Lembaga. Ini adalah selaras dengan prinsip mengumumkan maklumat-maklumat yang penting kepada para pembeli atau pengguna yang berpotensi.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><span style="font-size:12pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">         </span></span></span><u><span style="font-size:12pt;font-family:Arial;">Media elektronik</span></u><span style="font-size:12pt;font-family:Arial;"> – para Arkitek boleh membayar dan menggunakan semua bentuk media elektronik yang ada bagi mempromosikan perkhidmatan mereka dengan syarat-syarat yang telah ditetapkan oleh LAM.</span><span style="font-size:12pt;font-family:Arial;"> </span></p>

Langkah penggubalan Akta COB 2007 pula bagi mewujudkan jawatan Pesuruhjaya Bangunan yang berfungsi sebagai perantara antara pemilik unit strata dengan pihak pengurusan bangunan manakala konsep BKJ akan memberi pelbagai insentif kepada pemaju bagi menggalakkan mereka melaksanakan konsep baru tersebut.<span style="font-size:12pt;font-family:'Arial Narrow';"> </span></span></span></span></span></span></span></span></span></p>

Dan kita berpendapat lebih sesuai jika golongan ini terdiri daripada pelbagai disiplin supaya mudah memahami apa yang berlaku di bawah. Pasukan ini juga akan bertanggungjawab mendengar aduan. Laporan yang dikumpul akan dikemukakan kepada Jemaah Menteri dan Majlis Negara Kerajaan Tempatan. Sekiranya JPA meluluskan jawatan yang diminta, kita boleh memulakannya. Setiap tahap akan ada individu yang bertanggungjawab. Contohnya struktur bangunan, maka jurutera terbabit perlu menandatangani borang mengatakan struktur bangunan tersebut adalah mengikut spesifikasi yang betul. Ini diikuti tandatangan oleh arkitek yang bertanggungjawab menyerahkan borang tersebut kepada pihak berkuasa. Setiap tahap pembangunan perlu ada kelulusan spesifikasi. Maknanya ada individu yang akan dipertanggungjawabkan. Katalah jika berlaku sebarang masalah kepada syarikat atau arkitek itu sendiri meninggal dunia, mereka yang menandatangani borang-borang terdahulu masih ada lagi untuk kita rujuk. Maka tidak akan wujud masalah tiada siapa yang akan tidak bertanggungjawab di sini. Dalam masa sama, pemaju boleh melantik profesional lain untuk mengambil alih tugas. Berbanding dengan sistem lama, hanya satu borang permohonan yang perlu ditandatangani sebelum diserahkan kepada kerajaan tempatan.</span></span></span></p>

Kita sedar perkara ini dan telah meminda akta berkaitan bagi mewujudkan undang-undang lebih ketat. Tribunal Perumahan boleh membicarakan kes melibatkan kos RM50,000 berbanding sebelumnya hanya RM25,000. Pemaju yang ingkar boleh dibicarakan di mahkamah dengan denda minimum RM5,000 dan dikategorikan sebagai kesalahan jenayah. Dulu denda hanya RM800. Sebab itu mereka tidak takut. Pembeli yang menghadapi masalah dinasihatkan supaya merujuk kepada tribunal ini. Pihak-pihak tersebut adalah seperti juruperunding lain yang samada dilantik secara terus di bawah pengawasan Arkitek yang dilantik [<i>directly appointed under the team of architect</i>] atau yang dilantik khas oleh Klien sendiri, Pihak Berkuasa Tempatan [PBT] kerana Arkitek Profesional adalah ‘Orang Utama Yang Mengemukakan” pelan dan juga kepada pengguna-pengguna yang mempunyai hak kepada projek yang dilaksanakan. </span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:'Arial Narrow';">Arkitek profesional juga mempunyai liabiliti dari segi undang-undang seperti Undang-Undang Persekutuan [<em>Federal Constitution</em>] secara amnya dan akta-akta seperti Akta Jalan, Parit dan Bangunan 1974 [Pindaan 2007] [Akta 133], Undang-Undang Kecil Bangunan Seragam 1984 [Pindaan 2007] [Akta 133], Akta Arkitek 1967 [pindaan April 2007] [Akta 117], Akta Pemajuan Perumahan [Kawalan dan Pelesenan] 1966 [Pindaan 2007] [Akta 118]; dan Akta Hakmilik Strata 1985 [Pindaan 2007[ [Akta 318] dan lain-lain perundangan secara tidak langsungnya.</span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span><span style="font-size:14pt;font-family:'Arial Narrow';">Untuk memastikan Arkitek melindungi dirinya daripada mana-mana atau apa-apa liabiliti profesionalnya, langkah-langkah berikut adalah penting dan perlu/mesti diambil untuk memastikan dia tidak dengan semudahnya terjebak kepada permasalahan yang boleh menyebabkan integriti profesionalnya dipersoalkan atau digangugugat oleh mana-mana pihak yang tidak bertanggungjawab:</span><span style="font-size:12pt;font-family:'Arial Narrow';"> </span> </p>
<blockquote><p><i><span style="font-size:12pt;font-family:'Arial Narrow';">Memastikan perlantikannya dibuat secara rasmi [formal] dengan meminta Majikannya menandatangani Surat Perlantikan yang menyertakan Memorandum Perjanjian [Perjanjian antara Pelanggan dengan Arkitek bagi Perkhidmatan Profesional] menggunakan format LAM sebelum memulakan sebarang Kerja.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Derafkan Surat Perlantikan untuk juruperunding-juruperunding lain yang dilantik oleh Majikan dengan memastikan perlantikan mereka sepenuhnya secara esklusif supaya tiada skop kerja yang tertinggal yang boleh membebankan Arkitek di kemudian hari jika Arkitek diwakilkan oleh Majikan untuk melantik mereka.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Medokumentasikan kenyataan-kenyataan [</span></i><span style="font-size:12pt;font-family:'Arial Narrow';">statements<i>] yang jelas tentang pengecualian pihak Arkitek dari bertanggungjawab terhadap perunding-perunding yang bukan dilantik di bawah pengawasannya terutama terhadap ‘performance’, kecuaian [negligency] dan perlakuan juruperunding-juruperunding tersebut yang bertentangan dengan perundangan yang perlu dipatuhinya sama ada secara khusus dan secara amnya.</i></span><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Sekiranya pembayaran fee untuk perunding lain adalah melalui Arkitek, pastikan bahawa mereka bersetuju bahawa Majikan adalah bertanggungjawab terhadap fee mereka.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Terangkan kepada pihak-pihak lain atau mana-mana pihak ketiga bahawa apa-apa penganugerahan Kerja yang dibuat oleh Arkitek bagi pihak Majikan, pembayarannya adalah atas tanggungjawab Majikan.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Dapatkan kebenaran Majikan apabila hendak memulakan mana-mana fasa skop kerja Arkitek dan pastikan mendapat arahan bertulis dari Majikan sebelum memulakan sebarang peringkat skop kerja tersebut.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Membuat pengesahan kepada Majikan tentang fasa-fasa skop Kerja Arkitek yang telah disiapkan secara bertulis [jika rekabentuk sertakan set-set lukisan yang telah dipersetujui untuk disahkan oleh Majikan]. </span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Jangan berjanji untuk melakukan apa-apa skop kerja atau tanggungjawab yang di luar kemampuan Arkitek.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Jangan memberi jaminan tentang Kos Pembinaan.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Jangan berjanji untuk mendapatkan kelulusan pantas daripada pihak berkuasa.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Apabila terdapat elemen-elemen yang meragukan di dalam Kontrak dapatkan nasihat pakar profesional.</span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';"> </span></i></p>
<p><i><span style="font-size:12pt;font-family:'Arial Narrow';"></span></i><i><span style="font-size:12pt;font-family:'Arial Narrow';">Cuba jayakan parameter asas kehendak-kehendak Majikan sebelum memulakan kerja-kerja rekabentuk – contoh Kos, Kuantiti, Kualiti dan Masa – sekiranya tedapat perubahan pada parameter asas ini maklumkan kepada Majikan secara bertulis dan dapatkan pengesahan mereka.</span></i></p></blockquote>

<p><b><span style="font-size:12pt;"></span></b><b><span style="font-size:12pt;font-family:Arial;">Arkitek dilarang mengenakan bayaran kurang dari yang ditetapkan oleh Kaedah-Kaedah [Skel Fee Minimum] Arkitek 1986. Arkitek boleh didakwa di mahkamah jika ia didapati melanggar akta dan kaedah-kaedah Arkitek sepertimana diperihal dan ditetapkan di dalam </span></b><span style="font-size:12pt;font-family:Arial;">Kaedah-Kaedah Arkitek 1996</span><b><span style="font-size:12pt;font-family:Arial;"> iaitu Kaedah 28 [1] [Bahagian 1 Jadual Kedua] yang juga menggariskan Kod Tata Kelakuan Profesional Bagi Arkitek, di bawah kod-kod berikut:</span></b><span style="font-size:12pt;font-family:Arial;"> </span></p>
<p><span style="font-size:12pt;font-family:Arial;"></span><b><u><span style="font-size:12pt;font-family:Arial;">Kod 3: </span></u></b><b><u><span style="font-size:12pt;font-family:Arial;">Melaksanakan Tugas dan Kewajipan Dengan Taat Setia (</span></u></b><i><span style="font-size:12pt;font-family:Arial;">Code 3:Faithful Discharge of Duties and Obligations)</span></i></p>
<p><i><span style="font-size:12pt;font-family:Arial;"></span></i><u><span style="font-size:12pt;font-family:Arial;">Iaitu Kod 3[6]:</span></u></p>

<p><b><span style="font-size:12pt;font-family:Arial;"></span></b><span style="font-size:12pt;color:blue;font-family:Arial;">Seseorang Arkitek hendaklah sebelum menyetujuterima perlantikannya atau sebelum bersetuju menyediakan khidmat konsultansinya, memberitahu bakal Kliennya secara bertulis tentang <span>Syarat-Syarat Pertugasan Arkitek</span> [Jadual Ketiga Kaedah-Kaedah Arkitek] dan <span>skel fee profesional</span> serta caj yang sesuai yang akan dikenakan (sepertimana yang telah ditetapkan oleh Kaedah-Kaedah [Skel Fee Minimum] Arkitek 1986), termasuk cara-cara pengiraan fees berkenaan yang perlu melibatkan perkara-perkara berikut:</span><span style="font-size:12pt;color:blue;font-family:Arial;">[1] skop-skop kerja,</span><span style="font-size:12pt;color:blue;font-family:Arial;">[2] ketetapan tanggungjawab,</span><span style="font-size:12pt;color:blue;font-family:Arial;">[3] had-had tanggungjawab, jika ada, dan</span><span style="font-size:12pt;color:blue;font-family:Arial;">[d] prosedur penamatan khidmat konsultansi,</span><span style="font-size:12pt;color:blue;font-family:Arial;">Dan hendaklah, dalam tempoh enam puloh hari dari tarikh notis pengesahan/ persetujuan perlantikan diberikan kepada Klien, mendapatkan persetujuan tentang <span>Syarat-Syarat Pertugasan Arkitek</span> [Jadual Ketiga Kaedah-Kaedah Arkitek] dan <span>skel fee profesional</span> serta caj yang sesuai yang akan dikenakan. <b></b></span><span style="font-size:12pt;font-family:Arial;"> </span></p></blockquote>

Jika memerlukan kepakaran yang tinggi serta strategi perlaksanaan dan kerja-kerja penyeliaan yang rumit, ia perlu bijaksana merundingkan caj yang bersesuaian supaya tidak menjejaskan kualiti perkhidmatan yang akan diberikan. <p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:'Arial Narrow';">Perkembangan ekonomi mempengaruhi status profesion Arkitek dalam keadaan seumpama berikut:<span>  </span></span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">        </span></span></span><span style="font-size:14pt;font-family:'Arial Narrow';">Taraf atau pencapaian ekonomi yang lembab [</span><i><span style="font-size:14pt;font-family:'Arial Narrow';">recession</span></i><span style="font-size:14pt;font-family:'Arial Narrow';">] seperti apa yang berlaku dalam tahun 1985 hingga 1989 sebagai contohnya, telah menyebabkan ramai Arkitek Profrsional tidak mampu mengendalikan perniagaan praktis senibina mereka kerana tiada komisyen kerja yang diperolehi – ramai Arkitek Profesional berdepan dengan masalah sehingga ke tahap yang boleh menyebabkan mereka diikhtirafkan sebagai muflis. Pemberhentian kakitangan yang digajikan seperti Siswazah Arkitek dan kakitangan teknikal seperti Pelukis Pelan tidak dapat dielakkan. Sehingga, ada sesetengah Arkitek Profesional terpaksa beralih arah dengan mendapatkan peluang pekerjaan di luar negara.</span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:Wingdings;"><span>§<span style="font:7pt 'Times New Roman';">        </span></span></span><span style="font-size:14pt;font-family:'Arial Narrow';">Dalam keadaan status ekonomi memuncak pula menyebabkan Arkitek mendapat komisyen kerja yang banyak dan lumayan. Ada kes-kes tertentu walaupun agak asing, Arkitek Profesional tanpa disedari menjadi terlalu sibuk sehingga cuai memastikan perkhidmatan yang baik diberikan kepada Pelanggan atau Majikannya. Perlu diingat, Arkitek-Arkitek [Arkitek Profesional dan Siswazah Arkitek] adalah tertakluk kepada pelbagai peruntukan Akta Arkitek 1967, yang menggubal kaedah dan peraturan khusus untuk mengawal perlakuan profesional mereka. Atas sebab perkhidmatan yang buruk yang diberikan kepada Majikannya, Arkitek terdedah dengan potensi melanggar ketetapan Kod Tata Kelakuan Profesional yang membolehkan mereka didakwa dan diambiltindakan sewajarnya oleh LAM. </span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:'Arial Narrow';">Pencapaian status ekonomi yang cemerlang boleh juga membuka peluang kepada Arkitek Asing untuk memasuki pasaran tempatan. Arkitek Tempatan akan tercabar jika tidak berupaya bersaing dengan mutu perkhidmatan yang diberikan oleh Arkitek Asing. Masalah dengan Arkitek Asing ialah mereka tidak terikat dengan peruntukan peraturan yang ada di Malaysia. Mereka seringkali menggunakan khidmat Arkitek Tempatan, yang telah dimestikan mematuhi kehendak-kehendak Kod Tata Kelakuan Profesional Arkitek di Malaysia, yang mana jika tersilap perkiraan dalam melaksanakan khidmat mereka kepada Arkitek Asing tersebut, mereka [Arkitek Profesional tempatan] akan terjebak memungkiri peruntukan Akta Arkitek 1967 berkenaan.</span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';">Cabaran lain seperti penglibatan ahli profesional lain dalam skop kerja tradisi Arkitek. Contohnya, sejak beberapa tahun kebelakangan ini ahli profesional seperti Juruukur Bahan, Jurutera dan Pengurus Projek sudah mula mengambil alih skop kerja Arkitek sebagai pengurus projek. Kadang kala dalam konteks atau permasalahan seumpama ini, pendapat sesetengah pihak yang mengatakan Arkitek sendiri boleh dipersalahkan kerana sudah tidak lagi pakar memberikan khidmat profesionalnya, sebagai boleh diterima dan ditelan dengan pahitnya. Puncanya, Arkitek tidak sepatutnya melepaskan tanggungjawabnya sebagai orang yang bertanggungjawab memastikan setiap aspek pentadbiran dan pengurusan perlaksanaan satu-satu projek dilakukan oleh ahli profesional lain seperti menyerahkan sepenuhnya kepada Juruukur Bahan untuk menyediakan Spesifikasi, Dokumen Tawaran dan Dokumen Kontrak, sedangkan dia adalah orang yang berhak menentukan spesifikasi yang terbaik untuk penyataan bagaimana bangunan rekabentuknya perlu diperihalkan dan bagaimana satu-satu perjalanan kontrak binaan rekabentuknya perlu ditadbir.</span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:'Arial Narrow';">Kehadiran Juruperunding Pengurusan Projek [<i>Project Manager</i>] mutakhir ini, yang pendaftaran mereka direstui Kementerian Kewangan, juga secara langsung telah berjaya mengambil alih [</span><i><span style="font-size:14pt;font-family:'Arial Narrow';">supplanting</span></i><span style="font-size:14pt;font-family:'Arial Narrow';">] tugas Arkitek sebagai ketua kepada tim binaan [</span><i><span style="font-size:14pt;font-family:'Arial Narrow';">construction team</span></i><span style="font-size:14pt;font-family:'Arial Narrow';">] bilamana Arkitek hanya dilantik sebagai perunding kepada syarikat pengurus projek berkenaan yang majoriti pemegang saham atau pemilik syernya adalah dari kalangan ahli-ahli profesional lain dan yang paling anihnya ialah apabila individu bukan ahli profesional yang terlalu asing kepentingannya dalam industri pembinaan, seperti Akauntan dan Ahli Ekonomi juga dibolehkan menjadi salah seorang ahli lembaga pengarah Juruperunding Pengurusan Projek.</span><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;font-family:'Arial Narrow';"></span><span style="font-size:14pt;font-family:'Arial Narrow';">Terakhir sekali adalah cabaran dari kalangan profesion Arkitek itu sendiri bilamana adanya individu Arkitek yang bersikap tidak ambil peduli kepada peruntukan undang-undang berkaitan dengan profesion Arkitek dan tidak menghormati prinsip dan konsep sebenar keprofesionalan profesion Arkitek. Sebagai contoh, keujudan Arkitek Profesional [walaupun hanya segelintir kecil sahaja] yang mencari jalan mudah mendapatkan komisyen kepada penyediaan perkhidmatan dan tanggungjawab profesionalnya hanya dengan menjual tandatangannya kepada pihak ketiga, yang menyediakan skim rekabentuk dan lukisan binaan tanpa pengawasannya sebagai Arkitek yang sepatutnya dipertanggungjawabkan. Perlu dingat bahawa perlakuan ini melanggar ketetapan Akta Arkitek 1967 sepertimana ditegaskan di bawah Kod 3, Kod Tata Kelakuan Profesional Bagi Arkitek, iaitu Kod 3[8] yang berbunyi:</span><i><span style="font-size:11pt;font-family:'Arial Narrow';"> </span></i><b><span style="font-size:14pt;font-family:'Arial Narrow';"> </span></b></p>

Mereka-mereka ini tidak memberikan perkhidmatan sebagai juruperunding senibina profesional. Perkhidmatan mereka hanya diberikan kepada majikan mereka sahaja dan mereka di bayar upah dalam bentuk gaji. </span><span style="font-size:14pt;color:navy;font-family:'Arial Narrow';"> </span></p>
<p><span style="font-size:14pt;color:navy;font-family:'Arial Narrow';"></span><span style="font-size:14pt;color:navy;font-family:'Arial Narrow';">Arkitek Profesional yang menjalankan khidmat rundingan senibina memberikan khidmat profesionalnya kepada mana-mana pihak klien atau majikan yang memerlukan khidmat nasihat berkaitan dengan senibina dan mereka perlu dibayar yuran yang jumlah dan bentuknya telah ditentukan oleh Skel Fee Minima sepertimana yang telah ditetapkan oleh </span><a href="http://www.lam.gov.my/download/newlamform/scaleminfees.pdf"><b><span style="font-size:16pt;color:navy;font-family:'Arial Narrow';">Kaedah-Kaedah [Skel Fee Minima] Arkitek 1996.</span></b><span style="font-size:14pt;color:navy;font-family:'Arial Narrow';"> </span></a></p>
